We really don’t get a chance to talk about the Supreme Court much here on the Health Show...but today, we get to put on the black robes and find out why a major medical device maker is celebrating a supreme decision. On today’s Health Show, the case of Riegel Vs Medtronic. We’ll also talk about another problem with medical devices that has patients squirming...and hospitals looking for new standards to follow. And Dr. Stephanie Beling joins us to talk about how being fat doesn’t necessarily mean being unfit...at least not that unfit.

THE SUPREMES SIDE WITH MEDTRONIC
A recent US Supreme Court decision in Riegel Vs Medtronic, seems to indicate that if a medical device is approved by the Federal Food and Drug Administration, it will be very difficult for people injured by that device to sue the manufacturer. Jon Haber, CEO of the trial lawyers’ group The American Association for Justice reacted by saying: “Today’s Supreme Court decision in Riegel v. Medtronic limits the rights of people to receive justice through the legal system when they are injured by the negligence or misconduct of others. We believe this ruling seriously misconstrues Congressional intent.” On the other hand, Medtronic spokesman Rob Clark said: “This is an important decision for the medical device industry and our continued ability to innovate and bring lifesaving technology to patients.” To understand the origins and details of the case, the Health Show’s Jim Horne spoke with US Supreme Court expert Philip Allen Lacovara, Senior Counsel at Mayer Brown LLP in New York City.
